Throughout the site, the terms “we”, “us” and “our” refer to geni-toys.com.au. geni-toys.com.au offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

Order Placement / Pricing

– Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

– Website pricing is in Australian dollars and inclusive of GST. Please note that pricing and stock availability are subject to change without prior notice.

– In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

– Goods remain the property of GENI Toys until full payment has been received.

– We reserve the rights to adjust product pricing on our website at any time.

2. Delivery

– We will deliver to anywhere within Australia only.

– We aim to dispatch your order within 1-2 working days of receipt, providing that goods are in stock. During busy periods lead times for dispatch may be longer.

– Delivery costs within Australia will be a flat rate of $12.95 for Standard Delivery or $18.95 for Express Delivery. Free Standard Delivery is offered for orders with goods valued at $150 and over.

– Delivery costs to New Zealand will be a flat rate of $22.95 for Standard Delivery

– We will contact you by email to let you know when an order has been dispatched.

– Goods will be sent via Australia Post registered delivery.

3. Returns / Refunds / Cancellations

– Any incorrect, missing or damaged items received must be reported to GENI Toys within 14 days of receipt of goods by email or phone. We will require photos of any damaged goods to be sent by email to us for assessment and our records.

– There will be no credit given on order price difference, due to any price changes or for customer change of mind.

– If item(s) received is not what you ordered, please do not open the sealed packaging. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.

– GENI Toys owns the title of any extra goods shipped with your order that have been dispatched in error.

– Once an order has been processed for picking, modification or cancellation of orders by the customer may not be possible.

– Faulty goods claims must be emailed to us and be accompanied by images and batch numbers if applicable for processing to occur. Details regarding the sale and return of the product and how it was damaged/faulty must also be included.

– We endeavour to resolve all claims effectively and efficiently but any refunds or replacements are at our absolute discretion.

4. Payment

– Payments for orders must be cleared before dispatch occurs.

– Payments can be made by the options available at our checkout

5. Liability

– GENI Toys shall not be liable to the Customer, or to any other person whomsoever, for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the Products, other than expressly imposed by statute in terms of which it is not possible to limit or exclude liability.

6. Age Grade, Choking-Hazard & Safety Notice

– Certification. All GENI Toys' products are independently tested to, and comply with, AS/NZS 8124-1 & 8124-3:2020 +A1 2023 for children aged 3 years and over.

– Warning. Choking hazard, small parts. Not suitable for children under 36 months.

– Marketing stance. We do not market or supply GENI products for children under 3.

– User responsibility. By purchasing, you acknowledge the 3 + age grading and accept that any use by a child under 3 (or any use contrary to the instructions) is entirely at your own discretion and risk.

Limitation of Liability

To the maximum extent permitted by law:

– (a) GENI Toys, its directors, employees and distributors are not liable for any loss, damage, injury or consequential or incidental damages arising from (i) use of the product by children under the recommended age, or (ii) failure to follow the supplied instructions.

– (b) Our total aggregate liability for any claim, whether in contract, tort (including negligence) or otherwise, is limited to the purchase price you paid for the product. Sprintlaw

Australian Consumer Law (ACL) Statement

Nothing in these Terms excludes, restricts or modifies the statutory consumer guarantees that apply under the Australian Consumer Law. Where those guarantees allow liability to be limited, our liability is restricted to repair, replacement or refund (at our election). ACCC

Indemnity

You agree to indemnify and hold harmless GENI Toys Pty Ltd and its distributors from any claims, losses or liabilities arising out of (a) use of the product by a child under 3 years, or (b) any misuse, alteration or unauthorised modification of the product.

7. Disclaimer

– Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.

– Information contained throughout the web pages and in our database is believed to be accurate and reliable at the time of publishing. There may be misprints, human errors, and omissions. We reserve the right to make changes and corrections in prices, products, and specifications without notice.

– Images and dimensions displayed on this web site should be regarded as illustrative and for informational purpose only. The actual products may vary slightly to the images and dimensions stated.

– GENI Toys may change the content of its terms and conditions at any time without prior notice.

8. Obligations of the Customer

– As a Customer of GENI Toys, you must provide current, complete, and accurate information about yourself at all times.

9. Severability

– In the event that any part of these terms and conditions shall be deemed invalid, unlawful or un-enforceable to any extent, such terms or conditions shall be severed from the remaining terms and conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

10. Governing Law

– GENI Toys and the Customer agree that the terms and conditions of sale shall be governed by the laws of the State of Victoria.
